1. Acceptance

By creating an account, installing or using Vocalype, you agree to these terms of use. If you do not agree to these Terms, do not use the Service.

2. Description of service

Vocalype is a desktop dictation and transcription application. The product is designed to work locally by default on your device, with some optional cloud functions that can be activated by the user depending on the available settings.

3. User account

• You must provide accurate, current and complete information when creating the account.
• You are responsible for the confidentiality of your identifiers and the activity carried out via your account.
• You must secure your device, password and email access.
• We may limit, suspend or delete an account in the event of fraud, abuse, prohibited use or manifestly false information.

4. Subscription and payment

• Vocalype may offer a free trial, limited free plan, paid plan or other one-time offers.
• The prices displayed on the site or in the application may change in the future.
• Payments and subscription management are handled by Stripe.
• Unless otherwise stated, paid subscriptions automatically renew each period until canceled.
• You can manage or cancel your subscription via the billing area provided for this purpose or via Stripe when this route is offered.
• Unless otherwise required by law, payments already made are non-refundable for the current period.

5. Acceptable Use

You agree not to use Vocalype for:

• any illegal, fraudulent or deceptive activity
• circumvent technical protections, licenses, product limitations or payment systems
• resell, rent, share or redistribute access to the Service without written permission
• attempt to decompile, reverse-engineer or exploit the Service in any way that harms us or other users
• send content or uses likely to damage the infrastructure, security or stability of the service

6. Intellectual property

Vocalype, its brand, its interface, its design, its code, its texts and its visual elements remain the exclusive property of their respective owners. These Terms grant you only a personal, limited, revocable, non-exclusive right to use the Product for its intended purpose.

7. Availability and modifications of the service

We do our best to provide a useful and stable service, but we do not guarantee continuous or error-free availability.

• We may modify, improve, suspend or discontinue all or part of the Service at any time.
• We may fix bugs, change certain functions, limit access or remove elements of the product.
• We are not required to maintain any given feature, integration, pricing plan, or compatibility indefinitely.

8. Limitation of liability

Vocalype is supplied as is and subject to availability. To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent permitted by law, Vocalype cannot be held responsible for indirect damage, loss of data, loss of income, loss of business, misconfiguration, use incompatible with your environment or interruption of service.

You remain responsible for your backups, verification of your uses and control of the texts generated before sending or publication.

9. Termination

• You can stop using the Service at any time.
• You can request the deletion of your account using the means made available.
• We may suspend or terminate your access if you violate these terms, security risk, fraud, abuse or legal obligation.
• Termination does not automatically remove amounts already owed for a period already begun.

10. Personal data

The use of Vocalype is also subject to our Privacy Policy, which explains what data stays on your device, what passes through our services, and when a cloud provider can be used if you enable it.

11. Applicable law and jurisdiction

Unless otherwise mandatory, these conditions are governed by the law of the country of establishment of the entity operating Vocalype.

Any dispute relating to the use of the service falls, unless otherwise required, by the competent courts of the place of establishment of this entity.
